About Donovan Newton Solicitors

Established in 2003 Donovan Newton Solicitors provides advice and representation in the specialist areas of mental health and mental capacity law. Our team of solicitors have many years of experience and are dedicated to providing a quality service to our clients.

Our mental health solicitors advise people who are detained under the Mental Health Act 1983, and represent people at Mental Health Tribunal hearings and Hospital Managers' reviews. We hold a contract with the Legal Aid Agency to provide mental health law services across the midlands and East of England. We also represent clients from the midlands who have been placed out of area.

Our mental health law services include:

  • Providing advice and assistance in all areas of the Mental Health Act 1983, including admission to hospital, consent to treatment and aftercare provisions;
  • Representation at Mental Health Tribunals;
  • Providing advice and assistance at Hospital Managers' reviews and attendance at CPA meetings;
  • Advising clients about aftercare following their discharge from hospital; and,
  • Acting for patients and nearest relatives in displacement proceedings.

Our mental capacity law services include:

  • Deprivation of liberty safeguards (DOLs) reviews and court applications;
  • Disagreements as to whether a person has capacity to make a decision;
  • Disagreements, where a person lacks capacity, what is in their best interests;
  • Disputes about where a person should live (eg in residential care, their own home or alternate supported accommodation); and,
  • Other health and welfare decisions, for example decisions relating to what contact arrangements should be, what care a person should have.
