Mental Capacity Law

Donovan Newton Solicitors provides expert advice on all aspects of Mental Capacity Law including the following:

  • Deprivation of Liberty Safeguards; and,
  • Mental capacity health and welfare disputes.

We have the expertise and the experience of working closely with vulnerable individuals and their families to understand and protect their best interests. The firm acts for clients who are assessed as lacking capacity to make certain decisions about their own health and welfare, including:

  • Decisions about where to live;
  • Decisions about what care and support a person should receive;
  • Decisions about contact with family members and others; and,
  • Decisions about sexual relations.

This is a highly specialised area of law, focusing on issues central to a person’s life. At Donovan Newton, we offer an extremely personalised service, working closely with our clients, their families and care professionals. We have the ability to consider the often conflicting needs of P and other interested parties, knowledge of Court of Protection practice and procedure.

We strive to promote and support access to justice for vulnerable clients and offer reassurance to clients that we will represent their interests properly, to secure the best possible outcome.

Daniel Bradley can act as an Accredited Legal Representative (ALR) in Court of Protection proceedings, having obtained specialist accreditation in the Law Society’s Mental Capacity (welfare) scheme.

Costs

We hold a legal aid contract and we can provide services under the legal aid scheme, quite often on a non-means assessed basis. At other times, we must assess your eligability to receivelegal aid, which includes consideration of the merits of your case along with an assessment of your financial circumstances.

If you are not eligible for legal aid we can also provide services at affordable fixed fees or hourly rates. Whether it is a fixed fee or an hourly rate fee depends on the complexity of the case. We provide an initial free telephone consultation to discuss more about our services and fees.
